A Justiça Federal confirmou que, enquanto durar a pandemia de Covid-19, a União, a Fundação Nacional do Índio (Funai) e a Companhia Nacional de Abastecimento (Conab) estão obrigadas a entregar, mensalmente, cestas básicas e kits de higiene a todos os indígenas da região do médio Xingu, incluindo comunidades não aldeadas, indígenas urbanos e os migrantes Warao, originários de onde hoje é a Venezuela.
A sentença reafirma a decisão liminar de setembro de 2020. Ambas as decisões atendem pedidos do Ministério Público Federal (MPF), que demonstrou a recusa do governo brasileiro em prestar assistência alimentar e sanitária emergencial que garantisse a permanência dos indígenas em seus locais de moradia, para reduzir os riscos de contágio pelo novo coronavírus.

A Justiça Federal registra na sentença que, apesar das providências que a União, a Funai e a Conab informaram ter tomado, persiste o cenário de insuficiência alimentar e consequente insegurança aos povos indígenas, o que obriga integrantes das comunidades a se deslocarem para a cidade de Altamira.
Ainda em setembro do ano passado, o Ministério Público Federal (MPF) informou que a decisão não estava sendo cumprida desde outubro de 2020, mas a União havia alegado limitações orçamentárias para cumprir a ordem judicial. Por isso, a entrega de cestas básicas e kits de higiene estava sendo feita de forma descontinuada e, de acordo com o MPF, sem informar à Justiça Federal a quantidade exata de material fornecido.
“A entrega de itens de higiene e alimentação em quantidade suficiente para assegurar que não precisem sair do isolamento é medida essencial para a sobrevivência dessas comunidades”, destaca o texto.
